Richardson Guitars and Effects (we) offers our customers (you) products that, include but are not limited to, electric guitars and guitar effects. By using our products, services, and any site or social media account under our control (our products), you agree to all of the terms outlined here. A copy of these policies can be obtained by submitting a request via email to RichardsonGuitarCompany@gmail.com or through our Contact Us form.

We reserve the right to update these terms, at any time, with or without notice, and your continued use of our products constitutes your express agreement and acceptance of these terms. While we make efforts to notify customers of changes to these terms, it remains your sole responsibility to read and understand the most current version of these terms prior to using our products.

Copyrights and Intellectual Property

All of our designs, the content on our site(s), social media accounts, any public-facing account in any media that we manage, and all other tangible and intangible intellectual property created by or for Richardson Guitars and Effects and Personal Luthier, and all persons legally acting on our behalf, in any media, remains the sole property of Richardson Guitars and Effects. Any and all comments, reviews, and other content created by anyone in a public-facing space we manage (including but not limited to our social media accounts or Google business listing) and regarding our products, business, associates, and/or related subjects are also the property of Richardson Guitars and Effects. 

None of the content we own, including our designs, can be used or reproduced, in part or in full, in any format or media, without express written permission. Request permission by submitting a request via email to RichardsonGuitarCompany@gmail.com or through our Contact Us form.

Use

By using any of our products, you expressly agree that you use our products at your own sole risk, and you further agree to not use our products in any way that is illegal or harassing to any individual, or in any way that could potentially cause any injury or property damage.

You are advised, and agree, to use good judgement and safe practices, and to secure the services of qualified professionals when necessary. 

Your use of our products also means that you expressly agree to the following statement.

I, as a user of Richardson Guitars and Effects, and/or Personal Luthier, products and services, agree to use any Richardson Guitars and Effects, and/or Personal Luthier, product or service in a safe manner. I agree to follow all applicable safety measures and laws related to any such use, and to secure the services of qualified professionals when necessary. I also agree to avoid any activity or use that could injure myself or others, or could damage any property. I agree that I willingly accept sole responsibility for any injury, death, property damage, or any other loss resulting from my use of Richardson Guitars and Effects, and/or Personal Luthier, products and services, and I agree to the Hold Harmless statement included in these terms.

To receive products from Richardson Guitars and Effects, you agree to pay, in full, for any product you order prior to receiving it unless you have entered into a payment plan with us. You further agree that any deposit(s) paid on custom or commissioned products, or on any payment plan, shall be paid in full prior to Richardson Guitars and Effects building your project and that any such deposit is nonrefundable.

Refusal of Service

Richardson Guitars and Effects reserves the right to refuse service to anyone we deem to be violating these terms, anyone who may potentially be attempting to use our products to violate any law, or for any other reason we find fit without explanation, at any time, with or without notice.

Returns and Refunds

Richardson Guitars reserves the right to refuse or honor returns and refunds at our sole discretion and within compliance with applicable laws. All deposits paid on custom or commissioned products remain nonrefundable. In the event that you receive a defective product, or your order is damaged in transit, please contact  us through our Contact Us form to notify us of your issue. You agree to notify us at the earliest possible time from your discovery of any defect or damage. If you are not satisfied with your purchase, wish to return your purchase, or have any other issues related to returns, please contact us through our Contact Us form. All return requests are processed individually and in the order in which they are received.

Hold Harmless

By using our products, you understand that Richardson Guitars and Effects, Personal Luthier, and all persons acting on our behalf, cannot fully guarantee any outcome deriving from any Richardson Guitars and Effects product or service. You agree to hold harmless, defend, and indemnify Richardson Guitars and Effects, Personal Luthier, and all persons legally acting on our behalf, against any and all claims or losses, agreeing that, should you seek restitution, you shall be limited to only the cost of the products and services you receive, less any shipping costs and nonrefundable deposits.

You expressly acknowledge that Richardson Guitars and Effects, Personal Luthier, and all persons acting on our behalf, shall not be liable to you, any third-party acting on your behalf, or any class of which you are a part for any damages of any kind or any losses including but not limited to loss of goodwill, time, data, money, or any other tangible or intangible loss.

In the event of a dispute, you agree to release Richardson Guitars and Effects, Personal Luthier, and all persons acting on our behalf, from any and all claims, demands, and damages of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of, or in any way connected to, such dispute.

Privacy

Richardson Guitars and Effects collects no personal information beyond that needed to process orders, and we collect no additional information in the operation of our business that is not provided by you. The information we collect is used solely for contacting customers, operating our business, and providing products and services as described in these terms. Richardson Guitars and Effects does not sell, trade, or disclose your information to any party unless required to comply with all applicable laws.

Richardson Guitars and Effects will not collect demographic information related to any protected class, personal identifying information (such as social security number), passwords to any account, criminal background information, any political affiliation information, or any banking information not directly related to an open invoice. Richardson Guitars and Effects will never request payment without you first requesting to purchase one of our products. If you suspect you have received a fraudulent information request related to Richardson Guitars and Effects, please use our Contact Us form to report the issue.

Richardson Guitars and Effects may, in the normal operation of our business, use site, social media, email, or other analytics to improve our products and services. We may use cookies in the management of our sites to support the normal operation of business. 

Third-Party Affiliates

Richardson Guitars and Effects may, in the normal operation of our business, use third-party platforms to assist with web orders and other facets of our business. These affiliates may include but are not limited to Instagram, MailChimp, and Stripe. You, in the use of our products, agree to any applicable terms from these providers.

Errors, Inaccuracies, and Omissions

Occasionally, information related to Richardson Guitars and Effects, and or Personal Luthier, products or services and contained on our site or appearing as part of our social media accounts, marketing, or any other aspect of the operation of our business may contain typographical errors, inaccuracies, or omissions that may relate to product or service descriptions, pricing, promotions, offers, delivery charges, transit times, and availability. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information, or cancel pending orders if any of the said information or content is inaccurate at any time without prior notice.

No error, inaccuracy, nor omission shall constitute or provide any right or privilege to you or any party acting on your behalf.

We undertake no obligation to update, amend, or clarify any of said information, including without limitation, pricing information, except as required by law. No specified update or refresh date(s) to any other content we publish should be taken to indicate that all information we manage has been updated or modified.

Waiver and Severability

At any time, and for any reason, should Richardson Guitars and Effects fail to exercise or enforce any right or provision within these terms, such failure shall not constitute a waiver of such right or provision. If any part of this agreement is found by a court to be invalid, both parties (you and we) agree that (i) invalidation of one part has no effect on any other term and that all other provisions remain in full force and effect, and (ii) that the court should endeavor to give effect to the intentions reflected in these provisions.
